DOG PURCHASING CONTRACT - BREED QUALITY

This agreement is made, and hereby entered into, on this ________ day of ________________, 2007 by and between Jennifer Roberts of RISING STAR BORDEAUX (hereafter referred to as “Seller”), and _____________________________________________________ (hereafter referred to as “Buyer”), address:______________________________________________________________ Phone number: ___________________ e-mail (if applicable): ______________________________ For the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred Dogue de Bordeaux from the litter whelped on ______________ out of;

TERMS OF CONTRACT:

1) Seller agrees to sell and the Buyer agrees to buy one (check appropriate line) _____ male _____ female puppy from the above described litter.

2) Ownership of the puppy shall be transferred to the Buyer for the sale price of $ ________, to be paid in full on or before _______________ . Only after the full amount of the agreed upon amount is paid, may the puppy be removed from the Seller’s premises. If the balance is left unpaid by such date as of the _________ , this agreement shall be cancelled at the Seller’s option and Buyer shall forfeit the deposit given hereunder.

3) Buyer is completely satisfied with and waives any and all claims regarding the dog’s conformation, and outward appearance (meaning the dog meets the breed standard at this age).

4) Buyer agrees that any and all transportation costs, to and/or from the Seller’s premises, will be at the cost and sole responsibility of the Buyer.

5) Buyer agrees upon purchase of the puppy that the Dog will be registered with the name: RISING STAR’S followed by a name of the Buyer’s determination. Failing to use Seller’s kennel name in dogs registered name will result in this contract becoming null and void.

6) STIPULATIONS: This dog or bitch has been graded to be ______ PET or ______ SHOW quality (check appropriate line).

a) If pet quality, Buyer agrees seller will register said puppy on an UKC Limited Registration. This non-breeding registration will be held by Seller until veterinarian verification of spay or neuter is received.

b) If Show quality, Buyer understands this to mean that no disqualifying cosmetic faults as defined in the FCI Dogue de Bordeaux standard are evident at time of sale and further that no genetic disorders are immediately apparent.

7) BREEDING PREREQUISITIES: Breeding of a bitch shall be every other heat cycle or no more than one back to back cycle with a one year rest period before again breeding and ONLY after the age of 18 months old. A stud dog will NOT breed more than two bitches in any one week and only after the age of 15 months old.

a) Seller recommends, but does not require, that the dog/bitch is not used for breeding purposes until the age of 2, which at that time an Orthopedic Foundation for Animals (OFA) Certification of hips can be received. Seller also recommends the dog/bitch be screened for heart, thyroid, elbows, patella and eyes prior to breeding. PennHip method for hip screening is also acceptable.

8) MAINTENANCE:

a) Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites and - where indicated - heartworm preventative medications.

b) Buyer further agrees to provide this puppy with proper nutrition and proper exercise.

c) Buyer agrees that the puppy will NOT be left alone in a backyard or Kennel Only. The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or “tied out”. (see section 9) This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family.

d) Seller strongly recommends that Buyer attend obedience classes with puppy and provide proper socialization opportunities for puppy.

9) Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of moneys.

10) HEALTH GUARANTEE:

Seller warrants that the above-described puppy is in good health and free of communicable diseases at the time the Buyer assumes ownership. The Seller guarantees that the Buyer will receive all health records pertaining to this puppy at the time of purchase. Buyer agrees to have puppy examined by a licensed Veterinarian within 72 hours (not including weekends or holidays) of receipt of puppy. Any claims must be made within this time period and will be verified by Seller’s own veterinarian.

a) Should a show quality puppy, within 24 months from date of birth, be diagnosed with any genetically derived medical disorder (i.e. crippling hip dysplasia) which is attested to by both Buyer’s and Seller’s veterinarians, thereby causing Buyer and Seller to agree puppy cannot ethically be bred, Seller will, upon provision of veterinary reports and where applicable, Orthopedic Foundation for Animals (OFA) or PennHip report, provide Buyer with one of the following options.

i) Should Buyer choose to keep Puppy and accept partial refund, Seller will refund 50% of purchase price. Puppy must be spayed or neutered before refund check will be issued, and spay/neuter certificate must be provided to Seller by Buyer’s veterinarian of choice.

ii) Should Buyer choose to relinquish ownership of Puppy to Seller, Seller will refund purchase price less any shipping or miscellaneous charges necessary for transportation of Puppy to Seller.

iii) Should Buyer choose to keep Puppy and accept a replacement breed quality puppy, Buyer must pay pet price ($1000) and any shipping or miscellaneous charges associated with transport of replacement puppy. Upon receipt of spay/neuter certificate and $1000 Seller will provide a replacement breed quality puppy as soon as such a puppy is available to Seller.

b) Should puppy, within 24 months from date of birth, be diagnosed with any genetically derived medical disorder which is considered by both Buyer’s and Seller’s veterinarians to be extreme enough to warrant euthanasia Seller will, upon provision of veterinary reports and, where applicable, Orthopedic Foundation for Animals (OFA) report, provide Buyer with replacement breed quality puppy as soon as such puppy is available to Seller, or refund to Buyer 100% of purchase price.

*** Buyer must agree to maintain preventative care of puppy/dog in regards to hip dysplasia such as proper nutrition (including avoiding excessive nutrition), proper exercise, and preventing stress injuries (i.e. not allowing puppy/dog to jump from heights taller than itself at the shoulder and no forced exercise such as running, until at least 18 months of age). 11) Seller shall not be responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders, which are due to the Buyer’s negligence.

12) This contract applies to the original puppy only and is non-transferable to a second party. No replacement puppy will be given if the male or female has been previously bred.

13) Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of it’s progeny to any agent, pet store, or guard dog business.

14) Buyer agrees that should it become necessary to sell or otherwise place this puppy, the Buyer will notify the Seller before taking such action so that the Puppy may, at the Seller’s option, be re-purchased by the Seller at the original price.

15) Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all health screens, awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising.

16) Buyer hereby releases and agrees to hold Seller harmless from any and all liability for injuries or damages to person or property caused by dog while in possession or care of Buyer.

This agreement is made and signed by both parties to insure the will being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.
